Gaston Edgcomb: You almost definitely don't have grounds to return your car. Based on the description you describe, it's not absolutely the case that the dealer misled you (even if it is likely) - without proof of the dealer's knowledge of the car's condition, there is reasonable doubt that they were misled by their mechanic who performed the safety inspection (plus, the battery has nothing to do with the safety inspection anyhow).Furthermore, it doesn't sound like dealer is fighting getting these items fixed. Their obligation is to provide you the advertised vehicle, in safe driving condition, for a reasonable amount of time. As they are doing what they can to ensure it is in safe driving condition, and you mention no other issues with the vehicle, I don't see a case.The misrepresentation is meant for cases such as the dealer fails to disclose a car's history (such as if it was a former taxi or police car), lied about the vehicle's mileage (or tampered with the odometer)! , or if a major accident (over $3000 worth of damage, as I recall) wasn't mentioned. As it is, all you can do is report the shop for improperly certifying a vehicle, learn the lesson of Caveat Emptor (buyer beware), and make sure next time you get your mechanic to inspect a car before you buy it instead of after....Show more

Antwan Schrum: That would depend on the paper work you signed at the dealer...some have a 30 day guarantee to fix any problems...sounds like you bought a lemon here...it is possible the dealer will offer a replacement but this time get the mechanic to check it before you accept the car...
